Swiftscore Privacy Policy

Swiftscore LLC (“Swiftscore,” “we,” “us,” or “our”) operates Swiftscore, an online, AI-powered platform that helps education leaders streamline teacher observation, evaluation, and coaching. We conduct our business and website in order to provide the Swiftscore online platform to our customers.

1. Introduction
Swiftscore respects and is committed to protecting your privacy. This privacy policy (“Privacy Policy”) describes how we collect, use, share, and protect your personal information when you interact with us, including when you use our online teacher observation, evaluation, and coaching platform (our “Subscription Services”), visit our website (“Website”), or otherwise interact with us as a business, all of which we will generally refer to throughout this Privacy Policy as the “Swiftscore Services.” It does not apply to any third-party website or application that we may link to or which may be accessible from the Swiftscore Services.
Please read this Privacy Policy carefully to understand our policies and practices regarding your personal information and how we will treat it. If you do not agree with what you see here, do not enter into a contract with us, use the Swiftscore Services, or otherwise provide us with your personal information. By interacting with any of the Swiftscore Services, you agree to this Privacy Policy and our Terms of Service.
We may make changes to this Privacy Policy (see section 13 below). Your continued use of the Swiftscore Services after we change it means you accept those changes. If you have any questions at all about this Privacy Policy, contact us at will@swiftscore.org.
2. Third Party Websites
The Swiftscore Services may contain links to or integrate with third-party websites. We are not responsible for the information collection practices policies of those third parties. We encourage you to read and understand each third party’s privacy policy before using or providing any personal information to them.
3. Children Under the Age of 18
The Swiftscore Services are not intended for children under 18 years of age and we do not knowingly collect personal information from children under 18. No one may provide any information to the Swiftscore Services for children under age 18 or allow them to use the Swiftscore Services. If you are under age 18, please do not use the Swiftscore Services, use another person’s account, or provide any information on the Swiftscore Services.
If we learn that we have collected personal information from a child under 18, we will delete that child’s information. If you believe we may have any information about or from a child under 18 for whom we haven’t received parental verification, please contact us at will@swiftscore.org so that we can promptly delete that child’s information from the Swiftscore Services.
4. Information of Students
The Swiftscore Services are not designed or intended to collect the information of your students, including student records. We do not market to students or create student accounts and do not knowingly collect information from or about students.
Do not submit student information to the Swiftscore Services. If we learn that we have collected student information, we will delete that information. If you believe we may have any information about a student, please contact us at will@swiftscore.org so that we can promptly delete the information.
Notwithstanding the foregoing, if you or your school, district, or organization nevertheless require that we agree in writing to protect student, teacher, or other data in our care, please contact us at will@swiftscore.org to discuss and work toward entering into a mutually agreeable data protection agreement consistent with your state and local requirements.
5. Information We Collect and How We Collect It
When you use the Swiftscore Services, we collect information directly from you or your school, district, or organization (individually or collectively, “you”) when you provide it to us. We may also collect information automatically when you use certain Swiftscore Services. We may also collect information from third parties, such as information we find publicly and on the internet, or through our efforts to advance our sales, marketing, employment, and other business interests. We strive to collect only the information we need to provide the Swiftscore Services.
Information You Provide to Us
When you use our Subscription Services, you might provide us with names, emails, and passwords in order to log in, access, and use individual user or administrator accounts. You might also provide us with (or provide us with rosters containing) names, professional roles, and the names of the school or organization where those named individuals work. You might submit user-generated content, such as observation notes, evaluations, rubrics and framework choices, coaching plans, and audio (if enabled by you), as well as support communications and feedback using email, surveys, features within the Subscription Services, or through such other means we may use from time to time.
When you use our Website or interact with our business, you might provide us with information such as your name, email address, physical address, and phone number. You might also provide us with questions and comments regarding the Swiftscore Services. You might give us this information directly through our Website, such as when you click a button and email us a question, or when we ask you for the information in the course of our ordinary business, such as through our sales and marketing activities.
As a job candidate, you may also provide us with information relating to your application for employment with us, such as your name, phone number, email, education, licenses and certifications, and employment history.
You may also provide us with your contact information to offer us your own products and services.
Note that some user-generated content that you provide directly to the Swiftscore Services does not always specifically identify you, such as the content of your support request or feedback.
Information We Collect Through Other Technologies
As you navigate through and interact with the Swiftscore Services, we may use automatic data collection technologies to collect certain information about your device and your usage activity and patterns. For example, we may collect:
• Device information. We may collect technical information about your device and internet connection, including the device’s unique identifier, IP address, operating system, browser type, and approximate location. We may also access your device’s microphone so that you can enter information into the Swiftscore Services more efficiently.
• Usage details. We may automatically collect certain details of your access to and use of the Subscription Services and Website, including traffic data, pages and features used, timestamps, referring URLs, logs, and other communication data and the resources that you access and use on or through them. We may also collect information about your clicks, screen views, tutorial completions, feature usage, and general interaction patterns.
• AI inputs and user-generated content. When you use artificial intelligence (“AI”) features of the Subscription Services, we process the written or verbal text you submit (“inputs”) and the limited relevant context needed to complete the submission, using a third-party AI provider, Google Gemini (Vertex AI).
• Diagnostics and performance data. We may collect and maintain crash logs, error reports, and performance metrics.
• Notification information. To deliver notifications and respect your preferences, we may collect push notification tokens (identifiers used to deliver notifications to your device) and notification settings and statuses (for example, whether notifications are enabled).
• Stored information. We may also access metadata and other information in files stored on your device.
Note that we do not access or collect real-time information about the precise location of your device. We also do not intentionally collect health, biometric, or banking information, so please do not provide this information into the Swiftscore Services. We don’t store your voice information when you use your device’s microphone to enter information into the Swiftscore Services. If we develop the Swiftscore Services to access or collect any of these items in the future, we will update this policy and notify you.
Cookies and Tracking Technologies
The technologies we use for automatic data collection throughout our Subscription Services and Website may also include cookies or web beacons.
Cookies, also known as browser cookies or tracking cookies, are small text files placed on your device when you interact with our Subscription Services and Website. We may place and use these functional cookies on your internet browser in a range of ways to improve your experience, such as for authentication, keeping you signed in, remembering your name and preferences, feature flags, and language.
Some parts of our Subscription Services and Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those parts and for other related statistics.
To the extent any of these automated technologies are considered a sale of personal data, targeted advertising, or profiling under applicable laws and depending on where you live, you may be able to opt out from use of these automated technologies for such uses (see Section 8 below). Please note that some features and functionality of our Subscription Services and Website may no longer be available to you as a result of opting out.
Information from Third Parties
We may collect information from third parties and outside sources. For example:
• Integrations. We may collect information from third parties requested or authorized by you to integrate with the Subscription Services. For example, you may authorize or enable Google OAuth for secure delegated access, in which Google shares limited profile information and access tokens rather than credentials for your account authentication.
• Service providers. We may collect information from third-party service providers to assist with the maintenance, support, and delivery of the Swiftscore Services and with our analytics, product development, sales, marketing, hiring, and other business activities.
• Recruitment vendors. We may collect information from our recruitment partners to fulfill vacant job openings.
• Publicly available sources. We may collect information from the internet, professional networking sites, public records, or public social media posts to assist in our sales, marketing, hiring, and other business activities.
Collection of Non-Personal Information
Non-personal, de-identified, or aggregated information is information that cannot, on its own, reasonably be used to identify you personally. We may de-identify or aggregate your personal information that we have collected so that it can no longer be reasonably linked to you or your device. We commit to using reasonable technical and organizational safeguards to prohibit and prevent re-identification of such data and information. We may collect, use, and share non-personal, de-identified, and aggregated data and information for any purpose and without restriction.
6. How We Use Your Information
We collect and use your personal information to:
• Deliver the features, functionality, and security of the Swiftscore Services to you, including account creation and authentication, core functionality, and any other information, services, or reasons that you request from us.
• Generate AI-assisted evaluations, transcriptions, coaching suggestions, and reports.
• Respond to your support requests.
• Fulfill any purpose for which you provide it.
• Communicate with you about the Subscription Services and your account, including for support, notices, important service messages, and to inform you about features and functionality.
• Consider you as a candidate for employment, including to follow you through the interviewing and hiring process.
• Assist in our sales, marketing, hiring, and other business activities.
• Process payments and subscriptions and send receipts.
• Enhance and improve the Swiftscore Services through analytics, research, development, and other improvements (for example, using Statsig for experiments).
• Notify you and provide software updates and repairs and to support the reliability of our Subscription Services and Website, for example through diagnostics and crash reporting.
• Enforce our Terms of Service, detect and prevent fraud or abuse, comply with laws, protect the rights and safety of us, you, our users, and others, and maintain the security and integrity of the Swiftscore Services.
We may use de-identified and aggregated information to recognize you, improve model quality, develop features and functionality, estimate and analyze usage patterns, formulate product insights, and otherwise understand, maintain, support, and develop the Swiftscore Services.
7. How We Share Your Information
We do not sell your personal information to anyone, and we do not share it with third parties for cross-context behavioral advertising or marketing purposes. We may, however, share your personal information with third parties for specific and limited reasons, such as:
• To fulfill the purpose for which you provided it (for example, to provide the AI features of the Subscription Services).
• With authorized administrators and collaborators as you may direct and in accordance with your settings.
• To our third-party service providers, subprocessors, contractors, or vendors (“Service Providers”) that we use to support the Swiftscore Services and deliver the Swiftscore Services to you. These Service Providers are permitted to process information we collect from you and are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. For example, we may use a cloud hosting and infrastructure provider, such as Amazon Web Services, to store the information, or use analytics tools to understand and improve how our Subscription Services and Website are used, or diagnostic tools to troubleshoot and improve their stability.
• To our recruitment vendors, who use it only in accordance with our instructions as required by law.
• To our professional advisors, such as accountants, auditors, consultants, lawyers, and other outside professional advisors we may retain, subject to binding contractual obligations of confidentiality.
• To a buyer or other successor in the event we’re involved in a merger, acquisition, financing, reorganization, dissolution, or other sale or transfer of all or some of our assets.
• For any other purpose disclosed by us when you provide the information.
• With your consent.
We may also disclose your personal information for legal or safety reasons. For example, we may disclose your personal information if we believe disclosure is necessary to comply with a court order, law, or legal process or government request, or to enforce our rights arising from your interaction with and our provision of the Swiftscore Services to you. We may also disclose your personal information if we believe disclosure is necessary or appropriate to protect the safety, security, property, and rights of Swiftscore, you, our users, or others, including to prevent fraud, abuse, personal or physical injury, or security incidents.
8. Artificial Intelligence (AI)
Our Subscription Services use AI and machine learning technologies to help you optimize the usefulness of the Subscription Services in conducting your educator observations, evaluations, and coaching. When you use the AI features, we may process the data you input (such as text and voice inputs describing teacher observations and recommendations) to generate the AI outputs.
As we mentioned earlier, the Subscription Services utilize VertexAI to deliver the evaluation generation, transcription, and coaching support features and functionality. We transmit to Vertex AI only the minimum necessary prompts and inputs needed to perform the operation you request. We may also use your prompts and inputs to improve, train, and refine Swiftscore’s AI models, but we disable public model training for your inputs. If you do not want your data to be used for Swiftscore model training, you may opt out in the settings menu of your account. Where available, we enable Zero Data Retention (ZDR) for user prompts and data processed by AI. AI inputs and outputs are otherwise stored for a commercially reasonable period of time, after which we will delete or anonymize them.
Unless you include them in your inputs, we do not share your personal details with VertexAI. You should not input into AI prompts any personally identifying, student, or other sensitive information, such as Social Security numbers, bank details, private health details, anything that could be considered a student record, or anything else you wouldn’t want processed by a third-party service.
You are solely responsible for reviewing, editing, and determining the reliability of any AI output generated from your use of the Subscription Services.
9. Automated Decision-Making
We do not make important decisions solely using automated decision-making with respect to our Subscription Services and Website. Our recruitment providers, however, may use automated technology to select appropriate applicants for us to consider based on criteria we identify and provide to them based on the Swiftscore position you are applying to. Although the process of identifying suitable applicants may be automated, the interviewing and hiring decisions are performed by us.
10. Your Choices About Your Information
We strive to provide you with choices regarding the personal information you provide to us. For example:
• Do not provide. With respect to our Website, sales, marketing, hiring, and general business practices, you can choose not to provide your information to us.
• Cookies. You can control certain cookies in your browser. Blocking essential cookies, however, may impact the features and functionality of our Subscription Services or Website. Note that, like many websites, the Subscription Services and our Website do not respond to “Do Not Track” signals.
• Access, correct, delete, export. You may access, correct, delete, and export your personal information from the Subscription Services using the relevant settings or controls available within them, or by emailing justin@swiftscore.org, unless such actions are restricted, prohibited, or delayed due to any legal holds, your configurations, and back-up schedules.
• Integrations. You can turn off integrations. For Google OAuth, you can disable access in your Google account settings.
• Notifications. You can turn non-essential notifications on or off in your browser or other settings. Note that certain transactional emails are required in order to deliver the Subscription Services.
• Account information. You can update certain account details in the Subscription Services or by contacting us.
• Ending your subscription. You can let the term of your period of access to the Subscription Services expire or terminate your access as permitted by our Terms of Service or any contract you have with us.
11. How Long We Retain Your Information
We keep and store your personal information in our databases in the United States for as long as you are using our Subscription Services. Upon expiration or termination of your period of access to the Subscription Services, or if we terminate your access for any lawful reason, we will retain and delete your information consistent with our Terms of Service, our internal data handling practices, and applicable laws and regulations.
For our business and hiring purposes and Website, we will retain your information in accordance with our internal data handling practices consistent with our business needs and applicable laws and regulations.
When you otherwise ask us to delete your information pursuant to a valid deletion request, or when you ask us to delete the information of a student or child under 18, we will delete the information from our databases within a commercially reasonable period of time in accordance with our internal policies and practices and in compliance with applicable laws and regulations. We may, however, keep your information for a longer period if we need to for an overriding legitimate interest, such as legal reasons, to resolve disputes, to enforce our agreements, or for security reasons.
We will delete information using commercially reasonable and permanent means to make the information irrecoverable. We may, however, retain de-identified or aggregated information indefinitely.
12. Information Security
We have implemented industry-standard administrative, technical, and physical safeguards designed to secure your personal information from accidental and unauthorized access, use, alteration, disclosure, and deletion. These safeguards are appropriate to the sensitivity of the data collected by the Swiftscore Services.
For our Subscription Services, all personal information you provide to us is stored on our secure servers behind firewalls. Passwords are stored using industry-standard hashing. All personal information is encrypted while in transit using TLS 1.2 or higher and at rest using AES-256. We utilize strict access controls and least privilege permissions, row level security at the database layer with audit logs and monitoring, and regular security testing, patching, and vulnerability assessments.
The safety and security of your information also depends on you. You are responsible for keeping your password and login credentials confidential and secure. We are not responsible for the circumvention of any privacy settings or security measures included through the Swiftscore Services.
Unfortunately, the transmission of information over the internet is never completely secure, and no method of transmission or storage is 100% secure. We cannot guarantee the security of your personal information transmitted through or stored within the Swiftscore Services. Any transmission or storage of personal information using the Swiftscore Services is at your own risk.
13. Your State Privacy Rights
This section supplements our Privacy Policy and provides additional details regarding our collection, use, and disclosure of personal information of consumers in various states. Many states, such as California, Colorado, Connecticut, Delaware, Florida, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia, provide (or other states will provide in the future) their state residents with rights to:
• Confirm whether we process their personal information.
• Access and delete certain personal information.
• Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (except Iowa and Utah).
• Data portability.
• Opt out of personal data processing for targeted advertising (except Iowa), sales, or profiling in furtherance of decisions that produce legal or similarly significant effects (except for Iowa and Utah).
• Either limit, opt out of, or require consent to process sensitive personal data or process personal data of minors under 18, 17, or 16 years old.
The exact scope of these rights may vary by state. To exercise any of these consumer rights that apply to you and to us in your state, please email will@swiftscore.org.
If we deny your consumer rights request, you may have the right to appeal our decision. To file an appeal, please email us at will@swiftscore.org within 14 days of receiving our denial notice. You must include “Privacy Request Appeal” in the subject line and provide (1) your full name, (2) your email and telephone number, (3) the date we denied your consumer rights request, and (3) a description of the request and the reasons you disagree with our decision. We will notify you in writing of our decision on appeal within 45 days from the date you submit the appeal to us, including an explanation of the actions taken (or not taken) and the reasons for our decision. If you are not satisfied with the result of the appeal, you may contact your state’s Attorney General to file a complaint.
14. Users Outside of the United States
The Swiftscore Services are designed, hosted, and operated in the United States. At this time, it is intended for users solely located in the United States. We do not knowingly collect or process information from users outside the United States. By using the Swiftscore Services, you understand that your data will be collected, stored, and processed in the United States in accordance with U.S. laws and this Privacy Policy. If you are accessing the Swiftscore Services from the European Union, Asia, or any other region with laws governing data collection and use that differ from U.S. law, your access to and use of the Swiftscore Services is at your own risk.
15. Changes to this Privacy Policy
We may make changes to this Privacy Policy from time to time. If we make material changes to how we collect, use, or share your personal information, we’ll provide notice in the Subscription Services, by emailing you using the email address you have provided us, or by other reasonable means.
The date the Privacy Policy was last revised will be identified at the top of this page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you. Check back here periodically for any changes.
